A version of the Agreement is available in English. In the event of any discrepancy between the two versions, the French version shall prevail over the English version.

A – GENERAL TERMS AND CONDITIONS OF SALE

This agreement (hereinafter referred to as the “Agreement”) sets forth the terms and conditions that apply to the purchase of Les Affûtés’ services, i.e. equipment and tool use and instruction workshops. Les Affûtés is the corporate name used by Les affûtés inc. a joint-stock company whose place of business is located at 6552 boul. Montréal (Québec), H2S 3C6 and 1385 rue Ontario E, Montréal (Québec), H2L 1S1, and whose telephone number is 514-750-7252 (hereinafter, “Les Affûtés”).

Les Affûtés reserves the right to modify these terms and conditions at any time.

By using the Les Affûtés website, www.les-affutes.ca and all of its pages (hereinafter, the “Site”), to purchase services such as training workshops or gift cards, you agree to accept and be bound by these terms and conditions of sale.

I: AUTHORIZATION TO USE ELECTRONIC DOCUMENTS

You hereby authorize the exchange of documents and information between you and Les Affûtés. When you fill out the registration form, contact form or online purchase form, you agree that Les Affûtés may use your information to contact you and to store it in our system for future use in accordance with these terms.

II : SERVICE

Les Affûtés offers an online platform on the Site allowing users to purchase individual or team training workshops and gift cards for use upon purchase of such workshops (hereinafter, the “Services”).

III: OTHER DOCUMENTS, AGREEMENTS AND POLICIES

The use of the Platform and the activities of Les Affûtés are governed by these Terms and Conditions and by any other terms and conditions of use that may be presented at Les Affûtés workshops.

Access to the Services is conditional upon the user’s signature, prior to the activity, of the rules and regulations governing the use of the premises and the declaration of recognition of risks, which the user can read on the following page:

IV: REGISTRATION AND PAYMENT

To benefit from Les Affûtés services, you must register on the platform using the registration form and pay by credit card to open an account. You can also register by calling Les Affûtés and providing payment information over the phone, or by visiting Les Affûtés in person.

You will receive an e-mail confirmation of your purchase from Les Affûtés. Once the purchase of the Services has been made, the user of the Services must proceed with the reservation on the Site or by telephone, depending on the availability of the Services.

The advertised price does not include sales tax (GST and QST), and is quoted in Canadian dollars (CAD). Full payment for Services purchased must be made prior to booking and use of Services.

When you submit your information on the Site to purchase Services, you agree to provide true and current information about yourself and to promptly update such information as necessary to ensure that it remains accurate and complete.

V : CANCELLATION AND REFUND

Les Affûtés reserves the right to limit its quantities, to refuse or to cancel an order, including after the transmission of an order confirmation even if you have been invoiced. If your order is cancelled after your payment has been processed, you will receive a full refund from Les Affûtés.

VI: MINORS

Only users over the age of 18, or those capable of entering into binding contracts, may use the Les Affûtés Services. Minor users may use Les Affûtés only under the supervision of a parent or guardian, and may be restricted or prohibited from using Les Affûtés.

VII: APPLICABLE LAW AND JURISDICTION

Les Affûtés is based in Montreal. This Agreement shall be interpreted in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein.

VIII: ASSIGNMENT

You may not assign your rights or obligations under this Agreement.

IX: APPLICATION

You are bound by this Agreement and acknowledge that you are aware of your rights and obligations.

B – CONDITIONS OF USE OF THE DES AFFÛTÉS WEBSITE


I : GENERAL CONDITIONS

The user accepts and acknowledges that Les Affûtés reserves the right, at any time and without prior notice, to modify, change or update the Agreement. Use of the platform by the user after such modification constitutes consent by the user to abide by and be bound by the terms of use as so modified. We therefore strongly recommend that you reread these terms of use regularly. If the user does not accept these terms of use or, as the case may be, the terms of use as amended from time to time, or the privacy policy, the user must not use the platform and should leave the www.les-affutes.ca website, in addition to deleting the “cookies” and usage history on the web browser used.

II: DISCLAIMER, EXCLUSION OF WARRANTY AND INDEMNIFICATION

Les Affûtés does not warrant the accuracy, completeness, quality, suitability or content of the information on the Site. This information is provided “as is” without warranty or condition of any kind, either express or implied, including, but not limited to, implied conditions and warranties of merchantability and fitness for a particular purpose.

Any information contained in blogs, videos or other methods of communication on the Site is to be used for general educational purposes only. For trade-related advice or apprenticeship guidance, please consult directly with a member of the Les Affûtés team.

Les Affûtés shall not be liable for any direct, indirect, special, incidental or consequential damages, or any damages whatsoever, including but not limited to lost revenues, lost profits or loss of anticipated economic benefits, arising out of the use of or inability to use the platform, the information, documents and software contained therein, even if Les Affûtés has been advised of the possibility of such damages or even if such damages can be reasonably foreseen.

As a user, you will indemnify and hold Les Affûtés harmless from and against any and all claims, liabilities, losses and expenses (including legal fees) arising out of your use of the Platform and your breach of these Terms of Use. In addition, Les Affûtés reserves the right to cease providing the Services to you if you violate these Terms of Use.

You may not use or export the Information or any copy or adaptation of the Information in violation of any applicable laws or regulations.

 

C – PRIVACY POLICY


The protection of personal information is an important issue for Les Affûtés. Please read this privacy policy carefully and check back periodically for any changes.

I: SCOPE OF THE POLICY

This policy applies to all personal information that we collect through our platform at www.les-affutes.ca, or in the course of any communication, including the sending and receiving of e-mails, telephone conversations or any other technological means. This policy is intended to govern the collection, use and disclosure of your personal information, regardless of how it is collected (in writing, verbally or electronically through the platform).

II: COLLECTION AND USE OF PERSONAL INFORMATION

Your personal information is information that allows you to be identified, such as your first and last name, home address, e-mail address, home telephone number, cell phone number, date of birth, information about your court record and your conversations and exchanges with our representatives and lawyers, as well as your credit card information. This personal information is collected when you purchase a Service or communicate with us about our Services.


We only collect personal information that we reasonably require in order to provide you with high quality, personalized service. Personal information may be collected for statistical purposes or to improve our Services or your browsing experience.

Under no circumstances will your personal information be shared with third parties without your consent, except in situations specifically provided for in the Act respecting the protection of personal information in the private sector, i.e. in exceptional circumstances.

III: COMMUNICATIONS

We may communicate with our customers by e-mail. For example, when you subscribe to one of our Services or make an information request, you may or may not expressly consent to receive our newsletters and be added to our e-mail mailing list. Les Affûtés may also share information, including personal information provided on a voluntary basis, with its promotional, marketing and direct mail agencies.

If you do not wish or no longer wish to receive e-mails from us, you may unsubscribe at any time by updating your profile or by following the unsubscribe link at the bottom of any e-mail we send.

Some of the e-mails we send are operational and contain information essential to the proper functioning of our products or tools, such as messages concerning your purchases or updates to our products and services. These operational messages will continue to be sent to our customers when required.


IV – CONSENT

By submitting personal information to Les Affûtés and by using our Site, you consent to the collection, use and disclosure of such personal information by Les Affûtés in accordance with the Policy and subject to the terms and conditions permitted or required by law.

V: DATA ANALYSIS

The statistical information we collect is not linked to your personal information and is not used to identify you. The web analysis tool we use is Google Analytics (google.com/analytics). This data is collected automatically by analysis tools and is intended to give us an indication of our customers’ habits and purchasing processes. To collect this data, we use cookies, which are small files automatically stored on your computer when you visit our platform.
